Terms of Service

Welcome to Elizabeth Ashby. These Terms of Service ("Terms") govern your use of elizabethashby.com (the "Site") and your purchase of any products from us. By accessing the Site or placing an order, you agree to be bound by these Terms. Please read them carefully.

1. About us

elizabethashby.com is an online store selling women's clothing and accessories. In these Terms, "we", "us" and "our" refer to Elizabeth Ashby, operated by Miloš Fiala.

2. Eligibility

By placing an order with us, you confirm that you are at least 18 years old and legally able to enter into a contract.

3. Orders and acceptance

When you place an order, you will receive an email confirming that we have received it. This confirmation does not mean your order has been accepted. Your order is accepted, and a legally binding contract is formed, only when we send you an email confirming that your item has been dispatched.

We reserve the right to decline or cancel any order — for example, if an item is out of stock, if we identify a pricing or description error, or if we suspect fraudulent activity. If we cancel an order you have already paid for, we will refund you in full.

4. Prices and payment

All prices are shown in the currency displayed at checkout and include any applicable taxes. We make every effort to price our products accurately. However, if we discover an error in the price of an item you have ordered, we will contact you before dispatch so that you can choose to continue at the correct price or cancel the order for a full refund.

Payment is taken at the time you place your order. We accept the payment methods displayed at checkout.

5. Products and descriptions

We make every effort to display our products, including their colours and details, as accurately as possible. However, slight variations may occur due to your screen or device settings, and product images are for illustration purposes. Small differences between the image and the item you receive may occur.

All products are subject to availability.

6. Delivery

Delivery times are estimates and begin once your order has been dispatched. Full details are set out in our Shipping Policy. Risk in the goods passes to you on delivery.

7. Your right to cancel and return

You have the right to cancel and return your order as set out in our Return and Refund Policy and under UK consumer law.

8. Acceptable use

You agree to use the Site only for lawful purposes. You must not use the Site in any way that is fraudulent, that could damage or impair the Site, or that breaches any applicable law. You must not attempt to gain unauthorised access to the Site, its servers, or any connected systems.

9. Intellectual property

All content on the Site — including text, images, logos, graphics and design — is the property of Elizabeth Ashby or its content suppliers and is protected by intellectual property laws. You may not copy, reproduce, distribute or use any content without our prior written permission.

10. Limitation of liability

Nothing in these Terms limits your statutory rights as a consumer, or our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded by law. Subject to that, we are not liable for any indirect or consequential loss arising from your use of the Site or our products.

11. Events outside our control (force majeure)

We are not responsible for any delay or failure to perform our obligations where this is caused by events outside our reasonable control, such as extreme weather, strikes, transport disruption, or supply failures.

12. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time you place your order is the version that applies to that order.

13. Severability

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.

14. Governing law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales. This does not affect your statutory rights as a consumer.
